Agency & the Real Estate Transaction - meets NYS Agency Requirement which took effect 1/1/17.

This applied agency class will review how the performance of agency duties can affect an agent’s rights to compensation in a real estate transaction and how the same can be jeopardized when disregarded or not implemented with care. Actual case study discussion will include the consequences of failure to disclose, buyer offers through other parties and navigating competitive multiple offer situations.

Property Inspection Notice & Addendum

PINA Hacks: a series of cases discussing what real estate practitioners can and can not do with this form in contrast with what is taking place in actual practice.

Does the language of the form facilitate using the Home Inspection as a negotiating tool, encouraging purchasers to demand repairs from sellers? Is it appropriate that the real estate practitioner decides when to include the form with the contract of sale? Can the real estate agent have two PINA forms in a deal, a "clean"one for the lender and a different one between the parties to the deal? Why does the typical selling agent (subagent of the seller) have access to a confidential work product between the purchaser and the home inspection report they have hired a home inspector of their choice to perform? Is the real estate practitioner completing the form, describing repairs and quoting "costs to cure" beyond the scope of their expertise? Is the real estate practitioner circumventing appraisal, value and reinspection issues by not presenting this document to the lending institution involved in financing the sale? Are some lenders closing an eye to the form in an attempt to avoid complications in the transaction? Open to the public.
